General terms and conditions of booking apply between Sörmlands Naturpärlor AB, hereinafter referred to as Berg’s Gård, and the organizer and the person who enters into an agreement with Sörmlands Naturpärlor (the “Guest”) as stated in the Confirmation. The agreement applies to the rental of an accommodation and add-ons, hereinafter referred to as the arrangement/et.

1. THE AGREEMENT
As the organizer, Berg’s Gård is responsible to the Guest for what the Guest has ordered according to the agreement. The liability also applies to such services that are to be performed by someone other than Berg’s Gård, as long as these are included in the Arrangement. Information in catalogues, brochures and on bergsgard.se is binding for Berg’s Gård, but may be changed before an agreement is entered into if the Guest is clearly informed of the change. Berg’s Gård reserves reserves itself against possible printing or proofreading errors. Both before and after the contract is signed, Bergs gård can make insignificant changes to the accommodation and the range of options. In that case, Berg’s Gård shall inform the Guest.
As an Organizer, Bergs gård is obliged to ensure that:
• The guest will receive a written confirmation of their booking incl. other necessary documents.
• Information is provided about where the key can be collected and that the Guest is otherwise informed of other issues that are of importance for the completion of the Arrangement.
• The arrangement corresponds to the description in the Confirmation. Berg’s Gård is not responsible for promises that third parties may have made directly to the Guest without Berg’s Gårds knowledge and that Berg’s Gård did not know about or should not have known about. Berg’s Gård recommends that the Guest take this type of information in writing.
• It is the responsibility of the Guest to ensure that Bergs gård is provided with correct contact information for the Guest, including mobile number and e-mail address, as this information is necessary for Bergs gård to be able to provide Confirmation, check-in information, etc.
2. WHEN THE GUEST'S BOOKING BECOMES BINDING & PAYMENT
2.1 Binding effect of the reservation
The booking is valid for both Berg’s gård and the Guest as soon as Berg’s gård has accepted the booking through a Confirmation and the Guest has paid within the agreed time in accordance with the provisions of section 2. When paying, the booking becomes binding when the Guest accepts the payment terms, even if the Guest has not completed the transaction. It is the Guest’s responsibility to check that the information in the Confirmation is correct and to ensure that the Arrival and Departure dates are correct.
2.2 Payment
The guest’s payment must be completed in connection with the booking request. Payment is handled for online purchases through the Payment Service offered by our booking system, card payment via Stripe Checkout. By using the Payment Service, the Guest accepts the terms and conditions of the relevant Payment Service Provider.
When paying from abroad, the Guest shall pay transaction costs (e.g. transaction, currency and bank costs) in the home country and in Sweden. Berg’s Gård shall receive the agreed price in the specified currency stated on the Confirmation or stated in connection with the booking.
The guest can choose to pay for all or part of the booking with Bergs gård’s gift card. If the total cost exceeds the value of the Guest’s gift card, the Guest will have to pay the difference by credit card. Gift cards cannot be exchanged for cash. Payment by invoice is made via Fortnox Invoice Service, payment terms 15 days. We reserve the right to refuse the possibility of invoice payment as a payment option.
2.3 What happens if the guest doesn’t pay on time?
The booking will be cancelled if the agreed amount has not been paid in connection with the booking request. If the Guest does not pay on time, this is considered a cancellation, in which case the rules on cancellation apply (see more under section 3). The payment period is set out in these terms and conditions, unless a separate agreement has been made between the Guest and the Payment Service Provider).
2.4 RUT deduction for cleaning services
The guest can choose to use the RUT deduction on the mandatory final cleaning (departure cleaning). The possibility of using the RUT deduction only applies to private individuals and you must be entitled to the deduction. Read more at Skatteverket. Berg’s gård takes care of the application for the RUT deduction to the Swedish Tax Agency, if the deduction is denied by the Swedish Tax Agency, the Guest will be charged for the amount denied and an administrative fee of 200 SEK.
3 CANCELLATION AND REBOOKING
3.1 What if the Guest wants to cancel?
The guest can cancel the booking in writing to Berg’s gård or to the place that received the reservation. Berg’s gård only accepts cancellations by the Guest himself. Berg’s gård is obliged to confirm the Guest’s cancellation in writing. In the event of cancellation, Bergs gård is entitled to charge an administration fee of SEK 95.
3.2 Cancellation of the event
The event can be cancelled by the Guest, in which case the following applies:
• For events cancelled 45 days or more before arrival, Bergs gård will charge a handling fee of SEK 95. The remaining amount will be refunded to the credit card, the refund will be made immediately in connection with cancellation, the transfer may take 1-3 business days.
• For events that are cancelled 44 days or less before Arrival, Bergs gård will charge a cancellation fee corresponding to 100% of the total price of the event.
3.3 Rescheduling
For events that are rebooked 45 days or more before arrival, Bergs gård charges a handling fee of SEK 95.
For events booked via a third party, such as Booking and AirBnB, the respective third party’s terms and conditions for cancellation and rebooking apply.
4. GUEST'S RIGHTS AND OBLIGATIONS, ETC.
4.1 Obligations of the guest
In order to enter into an agreement with Bergs gård regarding accommodation, the Guest must be 35 years old. Everyone in the party must be at least 18 years old to stay in the accommodation. Compliance with the age limit is a requirement for access to the accommodation. Legitimation occurs. If the Guest does not meet the age limit when entering the accommodation, the cancellation rules in section 3 apply. The age limit does not apply to children accompanied by a guardian. When booking accommodation, a bed is mandatory for children over three years of age. For organized groups and travel groups with leaders, exceptions to the above rules can be made by agreement with Berg’s farm.
Guests can find up-to-date check-in and check-out information in their booking confirmation.
Between noon. 23:00 and kl. At 07:00, the Guest and all fellow travelers shall observe the utmost consideration and silence towards other guests. At other times of the day, mutual respect is shown with nearby residents. Disturbances are handled in collaboration with our security company. Disruption costs will be charged to the Guest regardless of the time of day. The cost amounts to SEK 1,500-5,000 per disturbance, depending on its nature and degree. The assessment is made in consultation with the security company.
The guest is fully responsible for any damage that occurs to the accommodation and its furnishings. Any damage to the accommodation or its contents will be charged to the Guest. Violations of regulations on smoking and pet bans will incur a clean-up cost from SEK 6,000. The guest may not use the accommodation for anything other than what was agreed upon at the time of booking.
The guest may also not allow more people to stay overnight or be present in and around the accommodation than what has been agreed or on any occasions. plot belonging to the accommodation set up tents, caravans, baths, music systems or similar. Departure cleaning is mandatory, the guest must clear the accommodation before departure in accordance with the cleaning instructions provided. Rough cleaning must be done indoors and outdoors as well as doing the dishes and emptying of garbage/empty bottles. If this is not observed, or the accommodation is otherwise not vacated in time at Departure, Bergs gård will charge a fee from SEK 1,500, depending on the size of the accommodation.
At the accommodation, the Guest is responsible for snow removal and/or de-icing in connection with the accommodation during the entire stay period.
Bergs gård is not responsible for forgotten things.
The guest may only charge electric vehicles at the designated charging point. Violation is prosecuted with regard to the risk of fire, whereby Bergs gård charges the Guest a fee of SEK 5,000. Bergs gård has the right to disconnect the Guest’s charging cable if it is used for charging electric vehicles at a place other than the designated charging point.
All keys to the accommodation must be handed in at Departure, otherwise a fee of SEK 2,000 will be charged for changing the locks.
Berg’s Gård has the right to terminate the agreement with immediate effect if the Guest or anyone in his or her company violates the rules of conduct, behaves in a disturbing manner and/or commits damage to the accommodation or its vicinity or if the accommodation is used for something other than the intended purpose. In the event that the agreement is terminated in accordance with this provision, the Guest and his/her party must immediately vacate the accommodation without refund of the accommodation price. Berg’s Gård is also entitled to charge the Guest an expense fee corresponding to the damage, but at least SEK 5,000. Bergs gård reserves the right to close the accommodation and remove the Guest’s belongings in the event of such immediate termination of the agreement.
4.2 Right to remedy, price reduction and damages
If the Arrangement is not carried out in accordance with the agreement, Bergs gård shall remedy the defect within a reasonable time. However, Berg’s gård is not obliged to rectify the defect if it is impossible or if the rectification would entail disproportionate costs. If Berg’s gård does not remedy the defect, the Guest may be entitled to a price reduction and/or damages. The right to a price reduction and/or damages due to errors during the stay (including, but not limited to, Interruptions) or due to Bergs gård cancelling the trip does not exist if Bergs gård can show that the trip could not be carried out or that the error arose due to obstacles or circumstances beyond Berg’s gårds control that Berg’s gård could not reasonably have been expected to anticipate when the agreement was entered into and the consequences of which Bergs gård also did not reasonably could have avoided or overcome, for example, short interruptions in IT operations, water or energy supply. It is the responsibility of the Guest to limit the damage as far as possible.
4.3 The guest’s right to assign the contract
The guest has the right to put someone else in his place and Bergs gård must accept this person unless there are special reasons. The guest must notify Bergs gård of the change no later than five (5) days prior to arrival. In the event of changes in bookings, Berg’s gård is entitled to charge a reasonable fee for the cost, as well as being able to show how the cost was calculated. If the agreement has been transferred, the transferor and the transferee are jointly and severally liable to Berg’s gård for what remains to be paid for the accommodation and for any additional costs that may arise due to the property. 4.4 Guest’s rights in the event of incomplete Arrangement
If the Arrangement cannot be provided in accordance with the Confirmation and these terms and conditions and Bergs gård is unable to offer the Guest other equivalent services, the Guest has the right to withdraw from the agreement. The Guest also has the right to withdraw from the agreement if the terms and conditions are changed significantly to the Guest’s disadvantage. Berg’s gård must then refund everything that has been paid for the Arrangement in question, with a deduction for any benefit the Guest may have had. In order for the Guest to be entitled to withdraw from the agreement, the Guest must notify Berg’s gård as soon as possible.
Errors that occur during the stay, the Guest shall report promptly and without undue delay during the stay so that Berg’s gård has a chance to correct it. If the Guest has not reported errors and deficiencies to the relevant staff on site and Berg’s gård, thus not having had the opportunity to be helpful, the Guest is not entitled to a price reduction or damages, according to practice and the booking conditions.
5. WAR, NATURAL DISASTERS, STRIKES, ETC. (FORCE MAJEURE)
Both parties have the right to withdraw from the agreement if the Arrangement cannot be provided due to acts of war, natural disasters, labour disputes, prolonged interruptions in water or energy supply, fire, decisions from authorities, epidemic/pandemic and other major disease outbreaks, or other similar circumstances beyond the parties’ control, which neither party could reasonably have foreseen or taken into account at the time of entering into the agreement and the consequences of which could not reasonably have been (‘force majeure situation’).
A party wishing to withdraw from the agreement in accordance with the first paragraph shall notify the other party of this without delay as soon as the party wishing to withdraw has become aware that a force majeure situation has occurred. A party is not entitled to terminate the agreement if the circumstances referred to in the first paragraph were generally known at the time the agreement was entered into.
6. PERSONAL DATA
When the Guest orders an Arrangement, personal data provided by the Guest, such as name and e-mail address, will be processed by Bergs gård and, where applicable, by other companies within the Bergs gård group. The guest’s personal data may also be processed by Bergs gård’s partners such as insurers, parking companies, as well as system suppliers hired by Bergs gård, etc. Berg’s Gård will also process necessary personal data that the Guest provides about any fellow travellers.
If, when ordering the Arrangement, the Guest provides personal data about other persons, the Guest must be sure that they are permitted to provide the information. If possible, the Guest should also ensure that these persons understand how their personal data may be used by Bergs gård. Bergs gård through Sörmlands naturpärlor AB is the data controller for the processing of the personal data collected. Bergs gård carries out all processing of personal data in accordance with applicable legislation and cares about the Guest’s privacy and wants to be transparent about how the Guest’s personal data is processed. 7. Dispute resolution
The guest should first contact Berg’s gård with any complaints. If the Guest and Berg’s gård do not come to an agreement in a negotiation, the Guest may turn to the National Board for Consumer Disputes (ARN) or a general court. A dispute can also be heard by the European Commission’s dispute resolution platform if the conditions for this are met.
